Terms of Use of MyGIX – The German-Israeli Exchange Network

1. Scope of application

1.1 These terms and conditions apply to the use of the internet platform "MyGIX – The German-Israeli Exchange Network" both in the desktop version and via the mobile app. MyGIX – The German-Israeli Exchange Network is operated by ConAct - Koordinierungszentrum Deutsch-Israelischer Jugendaustausch, Altes Rathaus – Markt 26, 06886 Lutherstadt Wittenberg (hereinafter "ConAct").

1.2 The use of the internet platform is exclusively subject to these terms of use in the version valid at the time of the conclusion of the contract (registration). Deviating terms and conditions of the users shall not apply unless ConAct has expressly agreed to their validity.

2. Description of services

2.1 With the Internet platform, ConAct provides registered users with a communication platform with various functions that are intended to enable networking, the exchange of experiences, discussions and joint, interactive work by users as well as the presentation of ideas within the framework of contacts from German-Israeli exchange programs and volunteer services.

2.2 The platform is available to users in both a desktop version and a mobile app.

2.3 The target group is former, current and future participants of German-Israeli youth exchanges in the field of school, extracurricular and vocational youth exchanges as well as volunteer services in Germany and Israel; as well as organizers of German-Israeli youth exchanges and experts and teachers in German-Israeli youth exchanges. Users who do not wish to use the platform in the context of German-Israeli exchange contacts are hereby informed that in this case they must use a different system. If users repeatedly violate this requirement, their user account may be deleted.

2.4 The internet platform is intended for users who are at least 12 years old.

2.5 ConAct endeavors to make access to the internet platform available to all users 24 hours a day, seven days a week. However, temporary interruptions of service, in particular due to the usual maintenance work, system-immanent disturbances of the internet as well as in case of force majeure, are possible. Users are therefore not entitled to uninterrupted access to the Internet platform at all times. No specific availability is owed.

3. Costs

3.1 ConAct does not charge users for the use of the internet platform. The mobile app for using the platform is also free of charge.

3.2 When using the internet platform, the user may incur internet connection costs, which depend on the respective contract of the user or any other contracts and therefore cannot be the subject of these terms and conditions.

4. Registration (conclusion of contract)

4.1 Upon registration, the contract between the user and ConAct is concluded.

4.2 To register, the user must click on the menu item "Sign up" on the Internet platform and truthfully fill in at least the mandatory fields of the registration form, i.e. specify an e-mail address and a password. Furthermore, the user must agree to the legal texts, i.e. the terms of use formulated here and the data protection provisions.

4.3 The user can correct, change and delete entries in the form at any time up to the point of submission. If the information does not meet the requirements, the user will receive a corresponding message. By clicking on the "Sign up" field, the user submits a binding application for the conclusion of a contract for the use of the Internet platform. The registration is thereby completed and the form is sent to ConAct. In response to this application, the user receives an automatically generated confirmation e-mail to the e-mail address entered by him/her. With the hyperlink contained in the confirmation e-mail, it is possible to fully activate the user's account. With the acceptance of the first login and the provision of the service, ConAct accepts the application.

4.4 Users who are not of legal age may only register with the consent of their legal guardians.

4.5 In the event of incomplete or incorrect data in the mandatory fields, in particular in the event of an incorrect e-mail address, ConAct reserves the right to delete the corresponding user account. In this case, however, the user can create a new user account by entering his or her data completely and correctly.

4.6 The following languages are currently available to the user for the conclusion of the contract: German and English. Communication with ConAct can take place in German and English.

4.7 The user must accept these terms of use when registering and can view them here. They can be saved using the "Save" function of the web browser and printed out using the "Print" function of the web browser. Apart from the terms of use, no contract text is saved. In their current version, these terms and conditions are made available on MyGIX – The German-Israeli Exchange Network.

5. Rules of conduct of the users, exemption

5.1 The users commit themselves to a respectful, appropriate and topic-related interaction within the internet platform.

5.2 Users shall comply with the applicable legal provisions when using the internet platform. In particular, photographs of third parties or photographs showing third parties may only be posted if this is legally permissible, for example because these third parties have given their consent. In the case of minors, the consent of their legal guardians must be obtained.

5.3 In particular, users are prohibited from,
- posting content without having the necessary rights to do so,
- posting content protected by law (e.g. by copyright, trademark, patent, design or utility model law) or advertising, offering or selling goods or services under signs protected by law (e.g. trademarks) without being entitled to do so,
- posting content that is discriminatory, inhumane, promotes or condones terrorism, is insulting, unlawful or contrary to public decency,
- posting pornographic content or content that violates the laws for the protection of minors or to advertise, offer or distribute pornographic content or content that violates the laws for the protection of minors,
- harassing other users unreasonably (especially through spam),
- engaging in or promoting commercial and anti-competitive activities,
- engaging in actions that are likely to impair the functionality of the infrastructure provided by ConAct, in particular to place an excessive load on it.

5.4 In case of violation of the above rules or illegal actions of users within the internet platform, ConAct is entitled at its own discretion to exclude users temporarily or permanently from the use of the internet platform (including the deletion of the user's account) and, if necessary, to take further measures to stop the violation. In such cases, ConAct is in particular entitled to remove content without prior notice.

5.5 Furthermore, the user shall indemnify, hold harmless and defend ConAct and its respective representatives from and against any claims (including reasonable attorneys' fees) asserted by third parties due to the alleged violation of these provisions or their rights. In the event of a claim by a third party, the user is obligated to immediately provide ConAct with all information necessary for an examination of the third party's claims.

6. Communication of offensive content
Users may at any time notify ConAct and its representatives of content they find objectionable. The notification can be made in particular by e-mail or via the link provided for this purpose within the internet platform.

7. Rules of conduct and responsibility of ConAct

7.1 ConAct will view the communication of users within groups on an ad hoc basis, especially if offensive content from groups has been reported.

7.2 The use of the internet platform is of no significance for the processing and approval of the funding applications received by ConAct and has no influence on this.

7.3 ConAct cannot technically determine with certainty whether registered users actually represent the person they claim to be. ConAct therefore offers no guarantee for the actual identity of the users. Each user must therefore convince him/herself of the identity of the other users.

7.4 ConAct assumes no responsibility for the content, data and/or information provided by users. In particular, ConAct does not guarantee that this content is true, fulfills a specific purpose or can serve such a purpose.

8. Contract period

8.1 The user can terminate the membership in the internet platform at any time without giving reasons by clicking on " Yes, I want to leave this network " in the user account. Alternatively, the user can contact ConAct in writing or by e-mail info@mygix.org.

8.2 ConAct may terminate the membership of users at any time with 14 days' notice in writing or by e-mail to the user.

8.3 The right of both parties to terminate the contract for good cause shall remain unaffected. ConAct shall be deemed to have good cause if the user violates these terms of use not only insignificantly or repeatedly, in particular if the user violates the aforementioned rules of conduct for users.

8.4 Upon termination, the user account and the user's account content will be deleted completely and irretrievably. ConAct reserves the right not to delete content posted on the internet platform, but the name of the user will be removed. The user can, however, demand the partial or complete deletion of the content created by him/her if it either violates the rules of conduct for users, if there is a legal obligation to delete it or if personal rights are violated in a disproportionately severe manner. In such a case, ConAct reserves the right to make the content concerned legally compliant.

9. Rights of use

By posting content on the internet platform, the user grants ConAct a simple, royalty-free, transferable, spatially and temporally unrestricted right to use the content to make it permanently accessible to the community on the internet platform. The user has the option to make the content accessible only to a limited part of the community via the function menu of the internet platform. These rights of use shall also apply to posted content beyond the term of the contract if and insofar as the user has not independently removed the content.

10. Modification of the terms of use

ConAct may subsequently change these terms and conditions if and to the extent that the main service character of the contract is not changed more than insignificantly as a result (see section 2). ConAct will inform the user of the changed conditions. If the user does not agree with these changes, he/she may declare his/her objection within six weeks after receipt of the notification of change. If no objection is made within this period, the changes shall be deemed to have been approved. In the event of an objection, the contract shall continue to apply unchanged, although ConAct may exercise its right to terminate the contract.

11. Applicable law, place of performance and jurisdiction

11.1 German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the user has his/her habitual residence in another EU member state, the applicability of these mandatory consumer protection standards of that state shall remain unaffected.

11.2 For all current and future claims arising from or in connection with this contract with merchants, legal entities under public law or special funds under public law, the exclusive place of jurisdiction shall be the registered office of ConAct. The same place of jurisdiction shall apply if the user does not have a general place of jurisdiction in Germany, moves his/her place of residence or habitual abode out of Germany after conclusion of the contract, or if his/her place of residence or habitual abode is unknown at the time the action is filed. Deviating provisions of Art. 17 et seq. EuGVVO regarding the place of jurisdiction for consumers remain unaffected.
